Under U.S. law, there are several ways to protect intellectual property, including patents, trademarks, copyrights, trade secrets, marketing plans, or a combination of all these. Our intellectual property consulting looks comprehensively at client needs to help secure a broad range of protections. We will work with you to evaluate what protection best fits your needs.

Determining Patentability

If it is determined that a patent is the right fit for your product, process, or design, our intellectual property consultants will then work with you to determine whether the invention is in fact patentable. There are several factors to assess, including:

  • Who can apply for a patent?
  • What can and can’t be patented?
  • Has your invention already been publicly disclosed?
  • What patents currently exist that may supersede your idea?

Our team will assess your product to determine if it meets the basic patent criteria of utility, novelty, and non-obviousness. We will also assess the stage of your product or design to determine whether it is ripe for patenting or may require additional development time before beginning the formal process.

Selecting Your Patent Category

Next, we will work with you to determine which of the three types of patents is most applicable to your invention. As discussed above, there are utility patents, design patents, and plant patents. Once secured, these patents will provide protection for 14 to 20 years, depending on the specific type of patent. If your idea or invention needs further testing or refining, but you want to secure basic legal protection, we can help you submit a provisional patent application (PPA). A PPA is good for 12 months and, while it doesn’t provide full legal protection, it offers several benefits—including putting an official filing date on the record with the USPTO which can be key to establishing a patent later on if competing ideas emerge in the marketplace.

Preparing and Submitting Your IP Application

Our intellectual property consulting services include the preparation of all the documents and forms required for your patent application submission. There are numerous legal requirements associated with each type of patent, so documents must be exact. We will also help you determine the fees you can expect to pay upon filing your application, including a basic fee, search fee, examination fee, issue fee, and potentially an excess claims fee. Once all documents are ready and correct fees assessed, we will help you to file online through EFS-Web, the USPTO's electronic filing system for patent applications. Nothing new can be added to the patent application once it is filed, so thorough preparation is crucial

Securing Patent Approval

When your application is deemed complete, the USPTO will assign an examiner to you. The examiner will review the contents of the application to determine if the application meets the requirements of 35 U.S.C. 111(a). An examiner may express objections to components of your application that you (or your designated agent/attorney) will have the opportunity to respond to. If you fail to respond within the required time, your application will be abandoned. If your application is approved, you will receive a Notice of Allowance. The notice of allowance will list the issue fee and may also include the publication fee that must be paid prior to the Patent being issued. Utility and reissue patents are issued within around four weeks of your fees being accepted by the USPTO.

Maintaining Your Patent

Utility patent owners are required to pay maintenance fees to the USPTO to keep a patent in force beyond 4, 8 and 12 years. If these fees are not paid, the patent will expire. VenturePlans will help you set up a maintenance fee schedule so that you can easily maintain your utility patent. Design patents and plant patents do not require maintenance fees.
